They can't sue. His name isn't Ken and he has a completely different backstory. Sure, he's blonde and what not... But that isn't enough. They would have just wasted money trying to sue Midway.

Usually I would say no to a soulless pariah like Kobra. However I could envision them improving and embellishing upon this once putrid character. After a passionate reimagining (they could change the color of his gi and make him oriental) I believe they can successfully transform him from a terrible Ken from Street Fighter clone into a terrible Ryu from Street Fighter clone. Either way I vote NO cause he's hella bad to the max.

Heck no for Kobra. His character was awful and if they wanted to make a character that's a rip off of Ken or anyone from Street Fighter then they did it 10 years late. If they want to give him a background cameo then that's fine. Maybe have him be a thug that both Stryker and Kabal threw in jail before the Outworld invasion.
