No I don't think Scorpion will be in.
He has been all over different consoles.
The characters in this game are Sony Exclusives.

Well, Sonic is not a nintendo exclusive, and we have Sonic in Brawl,,,same with Snake.
I really think, we gonna see some chances, after saw Kratos in MK9, Maybe we can see some Mk character as Third party.
